In theory, such uncertainty can *451 cause a situation in which one civil litigant could force another civil litigant to introduce his evidence to the jury and yet deprive him of any opportunity to introduce his evidence as to the defense in order to avoid a directed verdict. I believe that in civil practice, when the question is posed, the reason for the principle should be considered in determining whether it should be applied in a criminal context. That reason the danger of a jury verdict based on prejudice, confusion, or a mistake of the law does not exist in a criminal case. Because it does not exist, I would hold that the rule established by Penal Code section 1095 should not apply to a criminal case, nor should the rule be extended to permit the exclusion of any evidence that would tend to show innocence.

I do not believe that the exclusion of evidence pursuant to Penal Code section 1095 that would be admissible in a civil case would require the same preclusion in a criminal case. Although in a civil case I agree that the defendant’s reputation is material, in a criminal case, I do not believe that it is material to prove the defendant’s guilt. Therefore, I do not believe that the same precaution should be used to protect the defendant’s reputation in a criminal case as was used in a civil case.
